Kismat Terms of Service
Version 5. Effective: 3 November 2026 for new members. For members who accepted an earlier version, this version applies from 3 December 2026 or from the day you accept it, whichever is earlier. The rules on withdrawal, cancellation and refunds in section 8 and in the Subscription Terms apply to everyone from 3 November 2026 because they only give you more rights.
These Terms are the contract between you and us for the use of Kismat. Please read them. Where the law gives consumers rights that cannot be excluded, nothing in these Terms takes those rights away.
Language. These Terms are available in German and English. Both versions have the same content and are equally binding. You can contact us in German or English.
1. Who we are
Kismat is operated by P&P Management GmbH, Leebgasse 70, 1100 Wien, Austria, registered at the Handelsgericht Wien under FN 648928g ("Kismat", "we", "us"). Contact: support@kismat.at. Further company details are in our Imprint.
2. Who can use Kismat
- You must be at least 18 years old. Kismat is a service for adults only.
- You must be able to enter into a contract under the law that applies to you.
- You may have only one account. You must not use Kismat if we have banned you before.
- You must not be listed on an EU, Austrian, UN or US sanctions list.
If you are under 18, or if you give a false date of birth, we close your account. If there are signs that a minor is involved in sexual content, we report it to the authorities.
3. Your account
- You can sign up with an email address and password or with Apple or Google.
- Keep your sign-in details secret and tell us at support@kismat.at straight away if you think someone else uses your account. If you took reasonable care and told us promptly, you are not responsible for what someone else did with your account.
- Your profile information must be true and up to date. Your photos must show you.
- We may ask you to confirm with a live selfie that your photos show you, for example if the same photo is used on another account. If you do not do so within 24 hours, your profile is paused until our team has reviewed it (section 7).
4. What Kismat offers
- Free features: profile, the deck with suggestions, likes within a daily limit, matching, chat, Near You, Blind Date, Your Kismat (our official thread with you), safety and privacy tools such as reporting, blocking and Private Mode.
- Kismat Plus: an optional paid subscription with additional features. The Subscription Terms apply to it and form part of these Terms.
- Blind Date: a short live video call between two adult members who do not know each other yet. Video and sound go directly between the devices; we do not record calls. Either person can end or report a call at any time.
- Verification: members can verify with a live selfie and receive a verified badge. Verification is optional. Not every member is verified, and a badge is not a guarantee of who someone is.
How suggestions are ranked. Who you see first depends mainly on mutual gender preferences and age ranges, the same intent first and then others, distance within your radius, recent activity and profile quality (for example approved photos with a face). Super Likes and Priority likes (Plus) show your like earlier to the person you liked. You can change your preferences in the app at any time.
We cannot promise that you will find a match or a partner. Kismat brings people together; what happens between members is up to them.
5. Content you post
You keep all rights to the photos, texts, messages and other content you post ("your content"). You give us a non-exclusive, royalty-free right, limited to the duration of your use and worldwide, to store, copy, show, adapt (for example resize, compress or blur for Private Mode) and transmit your content, only to the extent needed to provide, secure and moderate Kismat. This right ends when you delete the content or your account, except for the copies we must keep for safety or by law (Privacy Policy section 10).
You confirm that:
- you own your content or may use it, and it does not infringe the rights of others (for example copyright or the right to one's own image, § 78 UrhG, § 16 ABGB);
- other people who can be recognised in your photos agree to appear on a dating service;
- your photos show you and are not taken from someone else, including famous people or influencers;
- your photos are not generated or changed by AI in a way that misrepresents your appearance (deepfakes, face swaps, fully AI-made faces).
Our Community Guidelines set out what photos and texts are allowed. Anyone, members and non-members, can ask us to remove an image of them that is used without consent (section 7 and the Notice and Action Policy).
6. Rules of conduct
You must not:
- pretend to be someone else or lie about your age, identity or gender;
- post or send nudity or sexual content, or any content that sexualises minors (also drawn or AI-generated);
- harass, threaten, insult, stalk, blackmail or pressure anyone, including sexual extortion and sharing intimate images without consent;
- spread hate or discriminate against people because of origin, religion, gender, gender identity, sexual orientation, disability, age or appearance;
- ask other members for money, gifts or crypto, offer sex work or escort services, or advertise products, services or other platforms;
- put contact details or links in your bio or in the first messages of a chat;
- use bots, scripts, scraping or automated access, get around limits, paywalls, moderation or checks, or attack our systems (security reports are welcome at support@kismat.at);
- record, screenshot or share another member's video, photos or messages without their consent;
- break the law.
The Community Guidelines and the Notice and Action Policy explain these rules in more detail and form part of these Terms.
7. How we moderate
We use automated tools and review by people to keep Kismat safe. The Privacy Policy (sections 5 and 6) describes them in detail. In short:
- Photo checks: every photo is checked by software on our servers and by the moderation service of OpenAI. A photo can be approved, held for a person, or removed after a short delay when a rule is clearly broken; you get the reason in Your Kismat and can ask for a person to look at it. Photos that may show a child are always decided by a person.
- Stolen-photo check: photos used on another account are held, and we may ask for a selfie confirmation.
- Messages and bios: fixed rules (no AI) detect contact details, links and typical scam patterns; such content can be removed or a message held for a safety check.
- Reports: every report reaches our team. Several independent, credible reports within 30 days place the reported account on a review hold automatically until a person has decided.
- Review holds: also after mass sign-ups from one device or network, signs of ban evasion, the return of a member who deleted their account while reported, or an unanswered selfie request. A hold pauses the profile in discovery and stops new first messages; existing chats continue.
- Bans: only a person on our team can ban an account.
Measures we can take: remove content, hold a message, pause a profile, remove the verified badge, limit features, suspend or ban an account. We choose a measure that is proportionate to the breach and take into account whether it was serious, repeated or intentional. For each such decision you receive a statement of reasons (Article 17 Digital Services Act) by email and in the app, stating what we decided, why, on which rule, whether automated means were used, and how you can contest it.
Complaints. You can contest a decision free of charge within 6 months by replying in the Your Kismat thread or writing to support@kismat.at. If your account is banned, the app shows you a form to appeal. A person reviews every complaint. The Notice and Action Policy also explains out-of-court dispute settlement and court remedies.
8. Kismat Plus and payments
The Subscription Terms set out prices, renewal, cancellation, withdrawal and refunds. The most important points:
- Plus renews automatically at the end of each period until you cancel. You can cancel at any time with effect at the end of the current period.
- On the website you pay through Stripe and cancel in Settings > Subscription or by writing to us. In the apps you pay through Apple or Google and cancel in your Apple or Google account settings.
- As a consumer you have a 14-day right of withdrawal. If you ask for Plus to start immediately and then withdraw, you pay only for the days you had Plus.
- Intro offers apply only to your first paid period; Plus then renews at the normal price shown before purchase.
- If we end your contract because we ban your account, we refund the paid time you can no longer use (section 9).
- A chargeback ends Plus for the disputed payment but does not lock or ban your free account.
9. Suspension and termination by us
We may suspend or terminate your account if you seriously or repeatedly breach these Terms, the Community Guidelines or the law, if you put other members at risk, or if we are required to by law or by an authority. For less serious breaches we warn you or restrict features first. You are told the reasons and can complain (section 7).
If we terminate your contract while you have a paid Plus period running, we refund the unused part of that period: for web subscriptions automatically through Stripe, for Google Play and App Store subscriptions as described in the Subscription Terms (section 13). This does not apply if the law allows us to keep the payment, for example as damages for a serious breach.
We may end the contract with a member who has not breached it with two weeks' notice, for example if we close Kismat. Paid time you can no longer use is then refunded.
10. Ending the contract and deleting your account
You can end the contract at any time by deleting your account in Settings > Account > Delete account. Deletion is immediate and cannot be undone. Data that we must keep for safety or by law is kept as described in Privacy Policy section 10.2; the delete screen tells you about the safety record.
Deleting your account ends a web subscription immediately and stops a Google Play renewal; there is no refund for the remaining period. If you are within the 14-day withdrawal period, withdraw first (Settings > Subscription) to get the refund for unused days. An App Store subscription must be cancelled in your Apple settings; deleting the Kismat account does not stop it.
11. Your safety
We do not run background checks on members and we cannot check everything members say about themselves. Verification is optional. Please be careful when you meet people: meet in public, tell a friend where you are, never send money. Our Safety Tips help. If you are in danger, call the police on 133 or the emergency number 112. Report behaviour that breaks our rules in the app.
12. Availability and changes to features
We work to keep Kismat available but cannot guarantee that it is always available without interruption, for example during maintenance, outages of providers or attacks. We may develop Kismat further and change or remove features, as long as this is reasonable for you. If a change significantly reduces a paid feature you have already paid for, we tell you in advance, and you can end the subscription and receive a refund for the unused time.
13. Liability
- We are liable without limitation for intent and gross negligence, for personal injury, under the Product Liability Act and wherever liability cannot be limited by law.
- For slight negligence we are liable to consumers only for breach of essential contractual obligations, limited to the typical, foreseeable damage. Liability for slight negligence towards businesses is excluded.
- We are not responsible for the behaviour of other members, on Kismat or offline. Our duties to act on reports and to remove illegal content are not affected.
- Your statutory warranty rights are not affected.
If you use Kismat not as a consumer but for business purposes (which is not allowed), you indemnify us against claims of third parties resulting from your breach of these Terms.
14. Our rights and notices of infringement
The Kismat name, logo, design, texts and software belong to P&P Management GmbH or its licensors. You may not use them without our written consent. If you think content on Kismat infringes your rights, send us a notice through kismat.at/report or to support@kismat.at with the content concerned, the right you hold, your contact details and a statement that your notice is correct and made in good faith.
15. Changes to these Terms
We may change these Terms for valid reasons, for example new features, legal changes or court decisions. We tell you about changes that affect your rights or obligations at least 30 days before they take effect, in the app and by email. You can accept the new version in the app. If you do not agree, you can delete your account or cancel your subscription before the change takes effect, without any cost. Changes that only give you more rights, corrections of mistakes and updates of contact details can take effect when published.
16. Applicable law and disputes
Austrian law applies, excluding its conflict of laws rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in the EU, you keep the protection of the mandatory law of your country. Consumers can sue us in Austria or in the courts of their place of residence; we can sue consumers only in their place of residence. For businesses, the competent court in Vienna has exclusive jurisdiction.
We do not take part in proceedings before a consumer arbitration body. If you have a complaint, please contact us first at support@kismat.at; we look for a solution with you.
17. Final provisions
- If a provision of these Terms is invalid, the rest remains valid. For consumers, the statutory rules apply in place of the invalid provision.
- You may not transfer your account or this contract to anyone else.
- We may transfer this contract to another company only with your consent, unless the law allows the transfer without consent (for example in a merger). We tell you in advance, and you can end the contract before the transfer takes effect.
- These Terms, the Subscription Terms, the Community Guidelines and the Notice and Action Policy are the whole agreement between you and us about Kismat. The Privacy Policy explains how we handle your data.
